under them) which by law may not be limited or excluded.

(a) all terms, guarantees, warranties, representations, or conditions which are not expressly stated in the Terms are excluded; and
(b) We will not be liable for any special, indirect, or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the products, services or these Terms (including as a result of not being able to use the products, services or the late supply of the products or services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

Typographical Errors
In the event that a MainosRata product is mistakenly listed at an incorrect price, MainosRata reserves the right to refuse or cancel any orders placed for a product listed at the incorrect price. MainosRata reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, MainosRata shall issue a credit to your credit card account in the amount of the incorrect price.
Use of Site
Harassment in any manner or form on the site, including via email, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a MainosRata or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. Indemnification
You consent to hold MainosRata, its officers, directors, employees, agents, licensors, and suppliers (collectively the “Service Providers”) harmless from and against all losses, expenses, damages, and costs, including reasonable attorney’s fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person using your Internet account.

Delivery Conditions
Orders for our non-printed products that are in stock will be shipped out the following business day after payment has been received.
Depending on the order’s value and the type of product, different delivery times apply to our custom-printed products. A FAQ area is located underneath the price on every product page. After we have received a signed copy of your artwork proof, it is stated in this FAQ section how long it will take to make and deliver your products. After you approve the artwork proof, we start producing the next business day. The deadline for approving artwork is 5 p.m. so that it can begin manufacturing the following day. When we ship the products, you become solely responsible for any loss or damage that may occur.
Custom-printed products are not eligible for refunds.
In accordance with the national privacy standards established by the Privacy Act, we respect your right to privacy and confidentiality with regard to the information you supply. Our privacy statement should be carefully read. By emailing us at info@mainosrata.com you can update your information whenever you’d like. Our secure server safeguards every piece of information we get from clients. All customer data is encrypted prior to transmission to us via our secure server software. In addition, we take security measures to protect all of the client information we gather. Our servers do not keep a record of credit card information.
Exclusion of void terms
Any clause or term that would be illegal, void, or unenforceable under any applicable law in any state or territory shall not apply in that state or territory and shall be deemed never to have been a part of these terms and conditions in that state or territory. If such a provision is valid and enforceable in any other state or territory, it shall be fully enforceable and a part of this agreement there as well. The complete enforceability and meaning of the other clauses of these terms and conditions shall not be affected or modified by the deemed excision of any phrase pursuant to this paragraph.
Force Majeure
We may terminate this Agreement by giving you at least seven (7) days’ notice if a Force Majeure event that is causing the delay lasts longer than thirty (30) days. “Force Majeure” refers to any action, condition, or failure to act that we were not reasonably able to control.
Jurisdiction
Any legal action brought by either party against the other that in any way relates to these terms and conditions will be heard in New South Wales, and you agree to submit to the jurisdiction of those Courts. These terms and conditions shall be governed by and construed in accordance with the laws of New South Wales.
In the event that any provision of these terms and conditions is found to be unlawful under any applicable legislation, such provision shall, to the extent necessary to achieve such validity, be modified, restricted, interpreted, or amended. All other provisions of these terms and conditions shall remain in full force and effect and, if required, the invalid provision shall be eliminated.
Any usage of the MainosRata login credentials given to or generated by the user is subject to liability, and this includes but is not limited to, any new services, campaigns, or inventory orders placed by users utilizing the user’s login credentials. The user is required to supply accurate, precise, current, and comprehensive information (“Access Data”) in the user’s account on the MainosRata website. Except when expressly permitted by law, the user’s account cannot be assigned, passed down through family members, or transferred in any other way without MainosRata’s written consent.
The User will immediately notify MainosRata of any abusive or unauthorized use of its Access Data or its user account and is liable to MainosRata for misuse of the User’s access and orders placed on the MainosRata website. If MainosRata reasonably believes that there are indications of abuse of the Access Data, MainosRata has the right to temporarily block the user’s access to the MainosRata website, exclude the user from using the Services, and remove offers of advertising campaigns from the MainosRata website. Access will be restored to the User as soon as such suspicion is removed and/or additional security measures (e.g., alteration of the Access Data) are implemented.
The user is entirely accountable at all times for the correctness and accuracy of the settings set by user concerning the type of Services it uses within the MainosRata website, including, but not limited to, being responsible for paying for any ordered inventory even if purchased inventory is incorrect or the purchase is unintended, in each case as a result of incorrect settings within the MainosRata website.
4.5. The user affirms and guarantees that it will not (without qualification or reservation of other restrictions herein) (i) engage in publisher retargeting, which is defined as any method of directly segmenting visitors of one or more specific publishers and then targeting that particular audience or group through other publishers; or (ii) collect and reuse data from third-party providers for targeting on platforms other than MainosRata or through the. Additionally, unless both the data supplier and MainosRata have expressly approved in writing, this data may not be gathered and sold on other platforms or through the MainosRata website.
4.6.The user understands and agrees that using certain third-party services may be subject to third-party service provider policies, which may be made available in the user interface (“UI”) of the MainosRata website and/or made available to the user at the time such third-party services are ordered through the MainosRata website. The user shall not use such third-party services if the user does not accept such policies. If the user chooses to utilize such third-party services, his or her use is governed by the terms of the relevant third-party service provider’s rules.
Except as permitted by law, the user of the MainosRata website, services, available technical specifications, and documentation (“MainosRata Materials”) shall not: (i) copy, disassemble, decompile, reverse engineer, or otherwise modify, in whole or in part, or create any derivative works of the MainosRata Materials; (ii) use the Services in a manner that is unlawful under applicable law, including but not limited to transmitting any content or data that is illegal or violates any Despite the aforementioned, the advertising materials may be copied as much as is required for the usage of the services.
